2024 saw further growth and maturation of Singapore’s restructuring and insolvency landscape. The Singapore courts issued judgments exploring the use of novel “supercharged” restructuring tools like pre-pack schemes and group moratoriums, alongside more traditional insolvency devices like statutory demands, insolvency set-off, and liquidators’ powers. Cross-border disputes continued to feature heavily. In addition, the Singapore courts also provided valuable clarification on the duties of directors in pre-insolvency scenarios, and the liability of insolvency practitioners.
In this update, we highlight 11 of the more significant decisions in 2024 and discuss their implications for the restructuring and insolvency space in Singapore.
