Vishi SUNDAR is a Partner in the Infrastructure, Construction & Engineering Practice.
Vishi has a broad dispute resolution practice, with a focus on civil and commercial litigation, and international arbitration. He has substantial experience with disputes in the infrastructure, construction and engineering sectors, both internationally and in Singapore. He has also advised and acted for government bodies, corporations and high net-worth individuals in matters involving corporate crime and investigations, public and administrative law, restructuring and insolvency law, defamation law, employment law and intellectual property law.
Written judgements by the Singapore Courts have commended Vishi for his "able conduct" of his clients' case, for demonstrating "a mastery of the authorities and evidence at hand", for his "immensely helpful" submissions, and for being "fundamentally cognisant" of his "duty to the Court and in the administration of justice".
The Legal 500 - Asia Pacific 2024 ranks Vishi as a Rising Star for the Construction practice area, describing him as a "sure bet as a future market leader", and highlighting that he is particularly "effective in dealing with complex technical matters".
Vishi also regularly represents individuals who are unable to afford a lawyer on a pro bono basis under the Law Society's Criminal Legal Aid Scheme.
Vishi graduated with a Bachelor of Laws (Honours) from the University of Nottingham and a Master of Laws from the University College London. He is admitted to the Singapore Bar.
Matters of significance in which Vishi has been involved in include acting for the following:
- The Land Transport Authority of Singapore, as lead counsel, in its successful appeal which involved a question of general principle to be decided for the first time, and a question of public importance, relating to the entitlement to certain rebates under the Road Traffic Act and its subsidiary legislation: see Land Transport Authority v Kenso Leasing Pte Ltd [2022] SGHC 222.
- A major European designer and manufacturer of steel plants in an SIAC arbitration against one of Asia’s largest steel producers, arising out of the construction of a large-scale integrated extrusion complex in South Asia. The dispute involved complicated issues of law and fact, including issues relating to suspension of works, variations, delays, fitness for purpose, and defects.
- A global digital infrastructure conglomerate in an action in the Singapore High Court against a major regional construction firm, arising out of substantial damage to fibre-optic telecommunication networks in the vicinity of certain foundation piling works.
- An industry-leading local construction and civil engineering company in an SIAC arbitration against a subsidiary of a major regional property developer, arising out of the construction of a luxury residential condominium in a prime area of Singapore.
- A global leader in air transport communications and technology in an SIAC arbitration against a major regional technology provider, arising out of a long-term teaming agreement for the provision of airport technology in a country in Southeast Asia.
- The Attorney-General of Singapore in various civil proceedings in the High Court and the Court of Appeal commenced by prisoners awaiting capital punishment, including for leave to commence judicial review, and for declaratory and private law reliefs.
